Please read the following terms and agreement for Wedding Photography Service.

THIS DOCUMENT constitutes a binding contract for photography services and/or products provided to the client(s).  The client agrees to hire and pay the Photographer to provide the services and/or products selected as stated and approved in Exhibit “A” - Proposal Agreement attached hereto.  The Photographer shall provide services to photograph the event and to the best of her abilities, in the manner described in this document.

2. Reservation of Payment.  A package proposal must be approved and signed with the payment of the non-refundable reservation/booking fee/deposit  to hold the date of the event.  The client agrees to pay the total package cost and has been fully informed about  the package and understands all the items included. Please attach the signed wedding package proposal at the end of this agreement.  Within 60 days, the Client shall confirm the final wedding package and date of services by signing and returning this contract with 50% of the total cost as deposit.  The Full Payment balance is due on or before the wedding day.  No date is reserved until the required deposits are received.  All final payments must be received on the wedding day before service is conducted.  In the event that the Client is unable to make final payment on the day of the event, an extension of payment may be requested by writing a promissory note and Client agrees to pay extension of payment fee of $150.00 on the day of the wedding in form of CASH.  The Client is only allowed to make one extension of payment. In the event the Client fails to remit payment as specified in the promissory note, the Photographer shall have all the right to terminate this Agreement without further obligation to deliver finished products, retain any monies already paid and dispose the images in any manner desired.

3.  Coverage.  The Photographer shall provide services to photograph the event and to the best of her abilities, in the manner described in this document.  The Client acknowledges and understands that the Photographer(s) cannot guarantee that any specific photo will be taken. The Photographer(s) will make every effort to accommodate Client’s wishes and acknowledges that there is a reasonable expectation of professional quality consistent with the photographers work. The Photographer(s) cannot be held liable for factors over which they have no control which may affect the quality of the photographs, such as Client lateness and photogenicity. Additionally, The Photographer(s)  cannot be responsible for the effects of the subjects’ physical appearance including body position, facial expressions, blinking or clothing. The Photographer(s) has the right to refuse to produce any image that could violate libel or copyright laws, or in the course of its production could cause or contribute to bodily injury, death, equipment damage or property damage or destruction. Any lists supplied will be used for organizational purposes only. 

4.  Other services. Note that any photography services such as engagement or boudoir photoshoots, graphic services, photo book printing, mtv/slideshows, complimentary or paid that are rendered outside the wedding date  are not covered in this contract. Photo sessions such as but not limited to engagement, family, boudoir  that are complementary will be released at the discretion of the photographer.  The Client, may arrange and request an advanced proofing or  purchase if  guest book, save-the-date or other print products are needed prior to the wedding event.  The photos from any photo session will be available for sale or download during the proofing period at an agreed release date between client and photographer

5.  Vendor Meals. The client agrees to provide at least 2 vendor meals to the photographer and assistant at no cost during the event. The photographers and assistants may alternately or joint take at least one hour break for rest or taking meals at an agreed time.  Failure to provide vendor meals will result in additional charges for the total cost of meals available at that time.  The total amount will be  included in the final charges.

6. Cancellation & Fees. If for any reason the Client cancels this wedding contract before the wedding date, the  Photographer shall keep the retainer fee and the non-refundable reservation fee.  The retention fee for cancelled wedding service will be assessed based on the payments made and should not exceed 25% of the total contracted price if cancellation is done within the reasonable period of 90 days from the date of booking.  Cancellation will not be allowed within 60 days prior to the event date.  Cancellation form must be requested in writing from the photographer assigned, signed by the contracted party, and sent via Certified Mail by the United States Post Office.  If the Client cancels beyond the reasonable time or if the  Client fails to supply written cancellation as specified before the wedding date or cancels within un-reasonable time (60 days before wedding), the Client shall be required to pay 50% of the total price as penalty for cancellation. 

7. Reschedule.  In the event that Client reschedules the wedding and the Photographer is able to rebook the new date, Client will receive credit for all monies already paid.  A new contract will be enforced and new package will reflect the pricing in effect when the change of date occurred.  In the event that the Client reschedules the wedding and the Photographer is unable to rebook the date, Client forfeits the non-refundable reservation fees but will receive all the monies paid.  All credits may only be applied to the wedding coverage within the 12 months/one year period from the date of the original date provided the Photographer is available.

8. Liability: If the Photographer or her agent is unable to perform any or all of the duties herein for any reason, including but not limited to, fire, transportation problems, acts of God, accident, illness, or technical problems, and if she cannot provide another competent professional, all money received by Photographer, minus expenses, will be returned to Client, and Photographer shall have no further liability with respect to this agreement. This limitation of liability also applies to any loss/damage of photographs or failure to deliver photographs for any reason. Liability for a partial loss of photographs shall be prorated based on the percentage of total. The sole remedy for any actions or claims shall be limited to a refund whose total amount cannot exceed the total monies paid by Client under this Agreement during the time preceding the date on which such liability arises.

9.   Photo Discs/DVD/USB: Upon receipt of a photo DVD/USB/download, Client accepts all responsibility for archiving and protecting the photographs. Photographer does not permanently archive image files. Photographer is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read discs provided. It is Client's responsibility to make sure that digital files are copied to new media as required.

10.  Online gallery for proofing: An online gallery will be provided to the client sharing and proofing for  a period of 12 months. The gallery will have  a shopping cart where other guest may purchase their own copies.  The Photographer is not responsible for the cost of  printing ordered from the gallery. The Client will be responsible for selecting their best images to print in album if applicable.

11.  Responsibilities. Unless agreed upon in advance, that the Photographer will have exclusive photography service coverage retained for the event. Photographer may bring one assistant at her discretion.  (a) Videographers and other vendors as well as semi-professional photographers must not obstruct or interfere with the official photography and are not allowed to take any still photos during formal sessions. (b) Wedding guests may take photos, but it is the responsibility of Client to prevent family and friends from interfering with Photographer's duties. Photographer is not responsible for compromised coverage due to causes beyond her control such as other people's camera or flash, the lateness of the bride/groom, family members and bridal party members or other principles, weather conditions, schedule complications, rendering of decorations, or restrictions of the venues or officiate.  (c) Photographer is not responsible for existing backgrounds or lighting conditions which may negatively impact or restrict the photography coverage.  (d) Client agrees to confirm the event program and schedule one-week prior to the event and to send the Photographer a copy of the invitation prior to the wedding. Notification of any changes in schedule or location must be made in a timely manner. Changes can be made by phone with a follow-up email for documentation. If email is sent, confirmation of receipt must be obtained

12.  Harassment: Ensuring the appropriate behavior of all guests and other persons at the wedding and other events covered by Photographer shall be the responsibility of Client. In the event Photographer or her employee experiences any inappropriate, threatening, hostile or offensive behavior from any guest or other person at the wedding or other event (including, but not limited to, unwelcome sexual advances and verbal or physical conduct of a sexual nature) then the following process shall be followed: first offense: a verbal warning will be issued to a family member of the client; second offense: the offending person will be required to leave the wedding or event; third offense: Photographer will end wedding coverage immediately and leave the event, Photographer shall be entitled to retain all monies paid hereunder and client agrees to relieve and hold Photographer harmless as a result of incomplete wedding or event photography coverage.

13. Other Personal Requests.  All personal request or services such as additional digital downloads not part of the wedding day such as photoshoots, test shoots are subject to photographer’s approval.  Please refer to statement in #4 about restrictions on Other Services.  This is to protect the quality of work that are being printed or packaged prior to the wedding day.

14.  Image Processing/Printing: The client understands that the work on display through websites, albums and other prints. has been retouched and the client will get untouched proofs, additionally retouching outside what is included in the package is an extra charge. Images determined by the photographer to be substandard or duplicated may be edited out. The Photographer will use her professional judgment and sole discretion to select which photos to deliver. Such selection shall constitute all images that will be made available to Client. Unless agreed upon prior to any editing work, high-resolution discs and/or proof sets may contain a mixture of color, black and white, and selective color images. An alternately colored version of a photo may be purchased at the current rate. Limited color correction and/or retouching are included at Photographer's discretion. Client may request further changes for an additional charge. Photographer is not responsible for any prints that are not ordered directly from her. For best results, clients with the high-resolution files should order their prints through a reputable lab.

15.  Copyright.  All photographs taken by the Photographer are property of the photographer(s), will remain the photographer’s property and are protected by United States Copyright Laws (USC Title 17). Client hereby waives any claims for ownership, income, editorial control and use of the images. Violators of this federal law will be subject to its civil and criminal penalties. Client agrees to purchase prints directly from Photographer unless in possession of high resolution digital files. Client agrees not to scan copy or reproduce images in any manner without written permission. Should Photographer become aware of reproduction without permission, Client will remit a usage fee of $300 per image, per usage to Photographer. If high resolution digital files are purchased, a written release will be supplied with those files. The release grants Client the right to reproduce the images provided for their personal use only and does not allow the photos to be altered, sold or published. Client further agrees not to supply images to any third parties (including vendors associated with the wedding or album designers).

16.  Model release. This contract serves as a model release giving the Photographer the irrevocable right to use the photographs in all forms and in all media and in all manners, without any restriction as to changes or alterations, for advertising, trade, promotion, exhibition, or any other lawful purposes. The Photographer can grant use of the images to third parties and all compensation for use and credit for the images remain the property of  the Photographer. Client waives any right to inspect or approve the photograph(s),  finished version(s) incorporating the photograph(s), or the use to which it may be applied, including written copy that may be created and appear in connection therewith. This release is binding on the Client, their legal representatives, heirs, and assigns. All of the above remains acceptable with exception to images that may have nudity or implied nudity or if Boudoir Photography session was requested during the day of the wedding coverage. 

17.  Boudoir Photography.  In cases when the Client agreed or requested for boudoir photography, the images resulting from this session will not be delivered as part of the wedding package without model release and written consent. Any images with any nudity or implied nudity will not be posted online or for advertisement without the Client permission as stated in our model release. The photography studio understands that boudoir photography is very personal and our studio respects your privacy. We will not share images online or in print without your permission. We never sell images to third parties. To obtain copies of the boudoir images, please submit a separate model release and privacy form from the photographer and attach as Exhibit 2.

18.  Emergencies: Emergencies such as serious injuries, serious illness or death to the signing parties to this agreement or their immediate families will cause this agreement to be null and void. Photographer will return any retainers made and will not charge for time or material expenses incurred while preparing for the shoot. Client(s) as well as Photographer must produce documentation in writing showing cause stating reason, relationship and have an excuse signed by an attending physician, charge nurse or funeral director. For the purpose of this agreement immediate family will consist of parents, stepparents, brothers, sisters, spouses, children, stepchildren, grandchildren and grandparents, as well as myself and the bride or groom. Either party may invoke this clause up to five days prior to the wedding causing this agreement to become null and void.

19.  Delivery and Post Production.  Once all payments have been received, the photographer will have a period of 120 days to process and publish the initial proofing gallery.  This images are will be available for proofing for 60 days.  It is the responsibility of the Client to select the approved number of images stated in the package selected as well as the best shots for the Album production.  All images will be automatically selected by the photographer after 60 days when the client is unable to pick the desired images.  We will provide the best post production processing but limited to making the images in good exposure and composition.   All editing and enhancing are only allowed on the images that will be printed for the Album.  Following the approved list of photo,  the layout of the album will be created at the discretion of the Photographer and the Client will be able to approve the design for 30 days .The Client is allowed to modify  only once per layout and limited to removal and replacement of the image and one change of layout.  All succeeding revisions will be billed accordingly.  If the client do not respond during the proofing period, the design layout will be assumed proofed and final.  Once the final proofs are submitted for printing, there will be no other alterations allowed.  The Album Printing production will take around 45-60 days.  We will notify you in every stage of the production.

21.  Upon signature, the Photographer reserves the time and date agreed upon. For this reason, all retainers are non-refundable, even if the wedding date is changed or cancelled for any reason except as noted in section 18 and in section 6 of this service agreement.

22.  Client has the right to a three (7) day grace period to exit this contract. Photographer must be notified in writing. The postmark shall not be older than three (7) days of the date following the signature of the contracting party. Photographer is not responsible for lost or undelivered mail.
